In no case shall WiZmed, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless WiZmed and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa.

SECTION 19 – REFUND POLICY

To be eligible for a return, your item must be unused, unopened (all seals intact) and in the same condition that you received it. It must also be in the original packaging. This must be reported within 7 days of receiving the order and all shipping costs to be borne by user, along with a 15% restocking fee being levied before a refund is issued. Furthermore, the product cannot be personalised or a special / clearance item. We reserve the right to accept or reject any return request based on these factors.

Exempted Products

Several types of goods are exempt from being returned. We do not accept the return of any personalised good such as embroidered lab coats or engraved stethoscopes which are free from defects. Should WiZmed sell any perishable goods such as food, flowers, newspapers or magazines, these would be exempt from returns. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

Additional non-returnable items:
* Gift cards
* Downloadable software products
* Health and personal care items (including stethoscopes and diagnostic sets)
* Products with adhesives

No partial refunds will be ever be granted, especially on
* Software or virtual products
* Any item not in its original condition, is damaged or missing parts for reasons not due to our error.

Unwanted Products

Unfortunately, we do not accept returns on any non-defective products. Please ensure the products you select are suitable when making a purchase.

Cancellations

All orders which are paid for cannot be cancelled. We will process all orders for which full payment has been made.

Sale items (if applicable)

Only regular priced items may be refunded, unfortunately sale items cannot be refunded. Orders that make use of our seasonal and promotional coupon codes deem your entire order to be a sales order, hence no refunds on unwanted items.

Eligible Items for Return

If a product you receive is defective you may be eligible for an exchange or refund. Where a manufacturer warranty is applicable, that takes precedence over any other policy. We will not replace / refund a defective product where it clearly falls under manufacturer warranty is applicable and is after a period of 7 days after purchase. Contact us if you feel your product is in some way defective.

Return Process

Once you have contacted us we will direct you to send the product to us. To complete your return, we require a receipt or proof of purchase.

Defective Products

Once your return is received and inspected, we will send you a message to notify you that we have received your returned item. We will then inspect the product to determine whether it is defective or not. The process of assessing whether a product is defective or not is solely at the discretion of WiZmed and any decision made is final. The assessment may take up to 4 weeks to be conducted.

Should WiZmed deem a product to be defective, the customer can request either a replacement/repair of the product or a refund. If you opt for a replacement, depending on where you live, the time it may take for your exchanged product to reach you may vary. If you opt for a refund, credit will automatically be applied to your credit card or original method of payment, within a reasonable period of time.

If it is deemed that your product is not defective you will be solely responsible for any costs incurred in the return process which includes, but is not limited to, costs involved in transporting the item between you and us.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted. Next, contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at hello@wizmed.co.za.

SECTION 22- PERSONALISED PRODUCTS POLICY

No personalised or engraved product may ever be returned unless the product is defective as per manufacturer policy and a return request is approved by us.

We engrave exactly what is on your order confirmation and invoice. If you make a typo/mistake, it is NOT our responsibility or liability, and unfortunately we cannot do anything about it. We therefore ask you to kindly double-check your engraving instructions before placing your order.

Should you make a returns claim in order to seek an exchange and upon inspection by our team, there is in fact nothing wrong with your order and we fulfilled the sales contract – you will be levied all relevant shipping costs before receiving your products back, as well as a R100 handling fee.

SECTION 23- INTERNATIONAL DELIVERY POLICY

We do not ship to known freight forwarders and all international sales must go through our in-house courier service arrangement with Aramex. We do not allow any collections from our facilities. If there are any errors in the address supplied to us and the courier cannot deliver the parcel, you will be liable for any/all redelivery costs.

SECTION 24- INSURANCE CAP

Please note that the standard insurance cap on our Standard Economy Delivery (Fastway) parcels is ZAR 1000 – if you would like to increase the insurance, contact us and we can quote you accordingly.

SECTION 25- BANK TRANSFER PAYMENTS POLICY

All orders placed via electronic funds transfer (EFT) must include a proof of payment, and such proof must be received by WiZmed before any order can be processed. In the event that the required proof of payment is not received, orders will remain pending and will not be processed until a valid proof of payment has been submitted.

Products will only be reserved for customers upon the receipt of payment. Please note that we cannot guarantee availability of any product until payment has been received and the order has been processed.

Orders that remain unpaid for a period of 24 hours will be considered cancelled. Should you wish to proceed with your order after it has been cancelled, you will need to resubmit your order and payment for the product(s) in question.

SECTION 27 – ORDER TIMEFRAME POLICY

At WiZmed, we are committed to providing accurate and reliable shipping estimates to all our valued customers. Estimated shipping times provided on our shipping methods are calculated in business days and exclude weekends and public holidays. Please note that unforeseen circumstances may arise which may affect the estimated shipping time. WiZmed will make every effort to dispatch orders within the estimated shipping time. However, we shall not be liable for any losses, costs, or damages incurred as a result of delayed shipping times.

The first working day of the estimated shipping time will be counted from the day following the successful clearance of payment into our account. In the event that your order contains backordered items, the entire order will be delayed until the item(s) have been restocked. It is essential to note that the restocking period for backordered items may take up to three weeks, and in some instances, it may take longer. We kindly request customers to contact us to confirm the estimated restocking period if in doubt.
